What Is a C100 Form?

A C100 Form is an official document required by the family court when making decisions about child arrangements. These arrangements are covered under what is now called a Child Arrangement Order (previously known as a "residence order" or "contact order").

Under Section 8 of the Children Act 1989, a C100 Form must be submitted when you ask the family court to determine how your child’s living and contact arrangements should be structured.

When Is a C100 Form Used?

A C100 Form is required when applying for the following types of court orders:

Child Arrangement Order
- Decides where a child will live and how they will spend time with each parent.
Prohibited Steps Order
- Prevents a specific action that may not be in the child's best interests (e.g., changing their school, taking them abroad, or altering their legal name).
Specific Issue Order
- Used when parents cannot agree on a particular matter, such as a child’s education or religious upbringing.

Do You Need a C100 Form?

Not everyone needs to apply for a C100 Form. This step is usually necessary when:

Parents cannot reach an agreement on child arrangements independently or through mediation.
Legal intervention is required to safeguard the child’s well-being.

Respondent’s Information (details of the other parent/guardian).

Safeguarding Concerns (if the child or applicant has experienced or is at risk of harm, including domestic abuse).

You also have the option to include a Position Statement, which is not mandatory but can be useful in providing additional details about your situation. This allows you to explain your perspective, outline a proposed arrangement, and give the court a clearer understanding of your case.

Mediation Requirement Before Applying to Court

Since 22nd April 2014, most family court applications require applicants to attend a Mediation Information and Assessment Meeting (MIAM) before submitting a C100 Form. Exemptions apply in cases involving domestic abuse, child protection concerns, or other specific circumstances.
